There is a product on the market right now that may be the answer to many smokers who are looking for a way to quit smoking without actually quitting. One of the main arguments against e-cigarette products is that there is no scientific proof to support claims made by e-cigarette manufacturers and distributors that state the product is safe for its intended use and safe for bystanders. New research out of New Zealand would make that argument invalid.
The company, Health New Zealand, released its study (found here: http://www.healthnz.co.nz/coynews.htm) this past April at the Society for Research on Nicotine and Tobacco (SRNT) conference. Their website states:
“Given that continued smoking of cigarettes carries a cumulative 1 in 2 death risk, the findings argue for:
1)less stringent regulation for very low-risk non-medicinal nicotine cigarette substitute products
2)the sale of this brand as a non-medicinal cigarette substitute, as its emissions have been tested”
The study suggested that because the operating temperature of an e-cigarette is only 5 to 10% of the temperature of a tobacco cigarette that they are, as a class of products, not likely to produce toxic substances in their mist that will affect bystanders.
Toxic emissions scores for the Ruyan brand of e-cigarettes tested compared to tobacco cigarette brands such as Marlboro revealed what most e-cigarette consumers already knew: tobacco cigarettes emit over 100 times more toxic chemicals than e-cigarettes do. From a list of more than 70 of toxic substances found in tobacco cigarette smoke, 0 of those toxicants were found in e-cigarette emissions.
Nicotine levels per puff were also analyzed: e-cigarette mist contains significantly less nicotine than tobacco cigarette smoke. Only 10% of the nicotine found in a normal puff from a tobacco cigarette was found in e-cigarette mist.
The conclusion that Health New Zealand came to was that e-cigarettes are cigarette substitutes and that if tobacco cigarette users switch to e-cigarettes that the health of both the smoker and the population will benefit. Although there is no way for any drug to be 100% safe, relative to tobacco cigarette emissions, e-cigarette emissions appear to be several hundred times safer. Health New Zealand also compared the e-cigarette to nicotine inhaler quitting aids, whose safety has never been questioned to the extent the safety of e-cigarettes has.

All of these are valid questions that someone addicted to smoking tobacco and nicotine have the right to ask before they switch from one smoking product to another. They know they already have an addiction to smoking tobacco and they want to know if they are just jumping out of the frying pan into a fire, so to speak. Yes, the electric cigarette really works. It gives you the nicotine you crave and allows you to engage in the smoking procedure that is as much a part of the addiction as the nicotine itself. It will satisfy your craving for nicotine because, of course, it has nicotine in the solution used in the device. It does cost less overall than buying tobacco cigarettes. There have already been many studies done on the electric cigarette and most of them are favorable. The FDA has not yet approved the smoking device and there are probably many reasons for this. For one, the FDA is underfunded right now and are having a hard time dealing with everything they have to oversee. This is evident because of all of the recalls on food products that are not inspected well enough and have caused health scares and illnesses to the public and also medications that have been approved and then removed from the market because they had really bad side effects that may or may not have been known about at the time of their approval by the marketers.
As far as getting nicotine poisoning from using the electric cigarette, anytime you take in too much nicotine you could be poisoned. This can happen using nicotine gum or patches too. Using the product as recommended is likely just as safe as using any other stop smoking aid that has nicotine in it and it is definitely better than smoking tobacco. As for causing cancer, research is still being done, but so far there has been little evidence if any that is really viable to show that the nicotine solution will cause cancer. While the electric cigarette or any other nicotine product might not be a perfect solution, it is much better than the proven cancer causing chemicals and tar that you get from tobacco.

E Cigarette Ban By FDA May Make Them A Real Danger To Smokers
Could a FDA stop on a well known smoking alternative create a potential for deadly results for U.S. smokers?
There are now reports flying across message and forum boards that a decision is near on the fate of the electronic cigarette. Several of the post concerning the case states that the decision has been made and the paperwork is ready for the announcement of the decision by a top federal judge.
This brings to the forefront a question that few have thought of concerning a potential ban of the e cigarette, and that is a black market for the e cigarette. The word on several e cigarette forums is that the Food an Drug Administration lacks the manpower to police all shipments into the US and that it will still be simple for the users to purchase them directly from China.
“This raises serious health questions that the lack of thought on the part of the FDA and special interest has refused to come to grips with” states Jeff Smith..an e cigarette merchant. “What you are doing is allowing these products to ship into the country that do not have any oversight. At least with US companies, they have a chance to lose money and thier reputations, and therefore you have a first line of defense on quality control, which will soon be gone as a ban takes place”
The FDA, which has no control in China to stop the flow of uninspected units into the country because of a lack of manpower and are potentially opening the special interest groups and the FDA to a landslide of lawsuits for forcing electronic cigarette smokers to use a potential dangerous product and putting their health and others around them at risk.

What many electronic cigarette users have feared from day one may be in the works
Philip Morris, the biggest maker of tobacco cigarettes in the US, has been discovered to be in talks with Ruyan Group, which manufactured the original electronic cigarette several years back in 2005. A news article found on Quamnet.com states the seriousness of the matter:
“Ruyan Group said that an agreement between the Company and Philip Morris International Management S.A. could not be reached on matters relating to the co-operation between them on its “electronic cigarettes” by the end of the first and exclusive phase of negotiations.”
As the FDA has been given authority recently over the tobacco industry, the move by Philip Morris could be a carefully calculated move to gain controlling interest over the products inside the US and abroad. The motives of the manufacturer are not clear at this point, but many speculate everything from shutting the industry down by acquiring the rights to it all the way to quite possibly launching its own electronic cigarette product and taking it mainstream.
Ruyan Group’s stock trading was suspended on November 2nd waiting an announcement on a price sensitive matter. A 20% sudden jump in the company’s stock price could be related to this .
But, that isn’t the first time Ruyan Group’s stock has soared. Back in June, the stock rose over 35% after the announcement that the manufacturer was negotiating with what Quamnet called an “independent third party”. Later on July 6th, that third party was found to be Philip Morris.
What this could mean for the electronic cigarette industry both internationally and in the US is uncertain, but what seems to be clear is: Philip Morris wants in.
In other related news, Ruyan Group Co. also sold their office properties for HK$28.57 million to an undisclosed buyer on October 23rd.

With a recent study in South Africa that shows some amazing results in helping people to quit smoking tobacco is a testament to the fact that electronic cigarettes, which was already a excellent alternative, may be deemed as a product that may help millions kick the habit of tobacco smoking. The study in South Africa stated that 45% of the people who used them for 8 weeks completely quit smoking tobacco.
Earlier in 2009 another study out of New Zealand by a world renowned health professional and ant-tobacco advocate stated that electronic cigarettes are between 100 and 1,000 times safer than traditional tobacco cigarettes. Health New Zealand was founded by Dr Murray Laugesen in 1995 after serving a full 18 years as an established medical officer in the Ministry of Health and in the Public Health Commission.
Dr Laugesen is one of the most recognized anti-smoking health practitioners in Australia and New Zealand and has been the recipient of many awards, including a medal from the World Health Organization in 1998 “for achievements deemed worthy of international recognition in promoting the concept of tobacco-free societies.” Dr. Laugesen claims that after having performed tests on electronic cigarettes, they are 100 to 1,000 times safer than commercial tobacco cigarettes.
With the progress of many studies and others that have been completed, the electronic cigarette market is a prime example of an open and free market that self regulates to make better and safer products for consumers. It seems that the only time that manufacturers are corrupted is when they become tangled in political corruption.

Self proclaimed public health organizations and federal agencies seem to have lost public trust over electronic cigarette fiasco.
Talk’s of a black market are already underway on many social sites and forums across the internet as the decision comes closer on the fate of the electronic cigarette in a federal court. Other than several special interest groups that are funded by huge pharmaceutical companies putting pressure on the Food & Drug Association to act against them, the general public and health officials are singing praises over the electronic cigarette.
News articles that attacks the electronic cigarette has comment areas that are stuff full with scientist and doctors, along with many of the population showing evidence of the need, want and support for this wonderful new product that nearly all ex smokers are calling a “lifesaver”.
Since the Food & Drug Association was in the spot light on the faulty testing procedures during their preliminary test on the electronic cigarette, and using personnel on the advisory board that have clear conflicts of interest concerning the electronic cigarette industry, the pubic is already showing signs of looking for other ways to get the electronic cigarette and saying that they will not use tobacco products by the same pharmaceutical companies that are funding the special interest fight against them.
Tobacco related illness deaths are 400,000 each year in the United States while legislators and special interest protect tobacco manufacturers from being banned through legislation that insulates tobacco and cessation markets from products that do work to rid tobacco.

The anti-smoking group (ASH UK) makes some surprising statements concerning the electronic cigarette.
With ASH (US version) holding a hard contempt for the electronic cigarette on the market, it’s original founders in the UK have gone in a total opposite direction from the U.S. based ASH that mimicked ASH U.K. in working to save over 400,000 smokers a year from sure and miserable death.
The United Kingdom version of ASH organization has now released a document that states that one of the few downsides of the electronic cigarette is that the levels of nicotine as “low”, and may not give users the amount of nicotine needed to keep them using the e cigarette over the real thing. They further state their support for other alternatives to tobacco.
“ASH supports a harm reduction approach to tobacco, that is, we see that while efforts to help consumers stop smoking should remain a priority, many people either do not want to stop smoking or find it extremely difficult to do so. For this group, we believe that products should be made available that deliver nicotine in a safe way, without the harmful components found in tobacco. Most of the diseases associated with smoking are caused by inhaling smoke which contains thousands of toxic chemicals. By contrast, nicotine is relatively safe. Therefore, electronic cigarettes, which deliver nicotine without the nasty toxins found in tobacco smoke, are likely to be a safer alternative to smoking. Also to add, e-cigarettes reduce secondhand smoke exposure since they do not produce smoke.”

It seems that the only lab that does not approve of the electronic cigarette is the U.S. Food And Drug Administration
LPD Services, a U.K. based lab that is fully accredited has submitted the results of its findings on the Gamucci line of electronic cigarettes. As most have suspected, the lab indicated that the electronic cigarette is much safer than traditional tobacco cigarettes.
There have been several reports from highly credible labs around the world on the electronic cigarette. One from South Africa, New Zealand, the U.K. and several others that are high profile in nature and performed by stout anti-smoking advocates that believe in harm reduction. All of these labs came back with the same result: the electronic cigarette is many times safer than traditional tobacco cigarettes.
There seems to be an air of change on the horizon concerning the electronic cigarette with strong lab results supporting claims of a smarter and safer choice over the tobacco cigarette. Top anti-smoking advocates like Dr Murray Laugesen, who has been the recipient of top awards from the World Health Organization in his fight against the harm of tobacco, supports the electronic cigarette.

PayPal, ASH and the FDA may have awakened a sleeping giant in the American population with corruption and political favors
ASH recently put out a press release stating that they had warned PayPal that they could be held criminally liable for processing payments for Electronic Cigarette retailers in an attempt to shut down online retailers from selling their goods online, but the public reaction may not be what ASH expected and may have just solidified the resolve of e cigarette supporters to keep them on the market.
Due to the pressure by these special interest groups, PayPal has now not only frozen the money in the accounts of these retailers, but made sure no other transactions can be completed by the retailers that use PayPal as their merchant system, putting many online retailers in a financial crunch.
The backlash has begun as message boards, and forums have lit up with angry members and postings concerning the act’s of ASH and PayPals decision to cave to pressures from the special interest groups. On several online forums, dozens of users have stated that they are canceling their PayPal accounts and vow to never use them again as a payment processor online.
There has also been speculation that PayPal has only targeted online retailers that sell e liquid while turning a blind eye to the actual electronic cigarettes, but the reports of retailers is growing by the day that are on the PayPal banned list, and some do not sell e liquid.
There have also been several discussions online and in comments of other news releases of the e cigarette users filing suit against Ash and Paypal for the actions and possibly forcing once tobacco free users back to tobacco products.
It seems that the general population is not buying the political tactics of the FDA, ASH and PayPal, but they are buying and supporting e cigarettes, the users and suppliers like electronic cigarettes national that was not a PayPal user.

Is ASH practicing corruption or are they concerned about the publics best interest?
ASH recently responded to a press release from an e-cigarette supplier out of the U.K. concerning the health effects of the e-cigarette on the public, stating that they are “a non-profit tax-exempt scientific organization” in their reply, while also claiming that they are a “US legal-action antismoking organization” on their homepage.
In an apparent attempt to discredit the e-cigarette supplier, ASH, who has direct ties to the New York Mercantile Exchange and the pharmaceutical industry, threw accusations that the e-cigarette company was biased “because it is written by an entity with an obvious financial interest in the topic,”
ASH again used speculative wording in their release such as “are potentially lethal to children” and used direct attacks on the credibility and authority of the e-cigarette company while citing the same FDA that can not balance its own checkbook, and also allows and encourages dangerous “approved” drugs to remain on the market. ASH points to the FDA as a “necessary scientific authority” regardless of their inability to manage their organization or willingness to act swiftly in removing products they have approved that are now proving to be very deadly indeed, including suicide-inducing Chantix and Zyban.
ASH then goes further claiming “other” necessary scientific authority and credibility sources as unnamed. Could this be due to the financial ties of those “other” authorities to the pharmaceutical industry that recently had a board meeting outline titled: “E-Cigarettes Will Revolutionize The Face Of Tobacco Smoking And Could Pose A Threat To The Smoking Cessation Market”?
“ASH claimed that there were no reputable scientific studies that have been completed on electronic cigarettes, but this is not fact either,” states Teresa Peach of Ecigarettesnational.com. “There have been several studies by government accredited clinical studies labs and another by a former principle medical officer in New Zealand’s Ministry of Health and Public Health Commission, Dr. Murray Laugesen. He received a medal from the World Health Organization in 1998 for his actions toward a tobacco-free society and to say that no credible studies have been done insults his medical degree and the fact that he is an internationally-recognized authority on tobacco issues.”
Considering the available information, it looks as though ASH has a lack of credibility itself on this issue in the public eye and the case will likely be decided ultimately by the federal court system in the ongoing lawsuit that is currently underway between two large electronic cigarette companies that are U.S. based against the FDA.

The points of the FDA seem to be drawing some hard questions that they may not be able to answer
As the FDA put out a news release concerning its stance on electronic cigarette products a few weeks ago, the administration only tested two different brands. What many e-cigarette users say is important about these brands is that they are made by the two manufacturers currently suing the FDA in federal court, Smoking Everywhere and Njoy.
“In comparison to the toxins and carcinogens contained in tobacco cigarettes, the FDA’s evidence that the products are dangerous is laughable at best,” says Coty Ellis, Public Relations Manager of Ecigarettesnational.com. “They only tested two brands and they just happen to be the brands suing them in court. Consider what e-cigarettes don’t have in them that tobacco cigarettes do: cadmium, nickel, radioactive Polonium 210, cyanide, butane, arsenic, acetone… the list goes on into the thousands. And they found… 1% diethylene glycol in 1 out of 18 cartridges?”
The doctors that performed the studies are also falling under scrutiny, because the public at large knows nothing about them. Who they are, who their past affiliations are, and perhaps most importantly, what their own political leanings are. One of them, Jonathan Samet, M.D, has been railing against anything having to do with smoking since the 1980’s. Joshua M. Sharfstein also served as health policy advisor to Congressman Henry A. Waxman, originator of the Family Smoking Prevention and Tobacco Control Act signed by President Obama this summer. The bill gives the FDA authority over tobacco products, while at the same time stating that the FDA has absolutely no authority to ban them.
“These aren’t unbiased health studies,” says Ellis. “They’re studies by the same basically bankrupt FDA that can’t tell Congress how much more money they need because they can’t afford to hire someone to find out how much more they need. They let known suicide-inducing drugs like Chantix and Zyban stay on the market when they’re known to be very dangerous. We’ve been accused of being biased in the studies our industry has had done, now we’re accusing them.”
Others are concerned that the FDA is attempting to overexert itself, given the fact that it is largely over budget and burdened with “a plethora of inadequacies”, as the administration stated back in 2007. The administration’s self-admitted shortcomings have yet to be addressed, according to the Government Accountability Office as of July 20th, 2009. The FDA admitted that out of the 522,000+ drug-related adverse-event reports in 2008, they have no idea which or even how many of those reports have actually been reviewed.
Inadequate funding, lack of leadership, lack of up to date scientists, and an ancient computer network give pause to average citizens presented with the idea of the FDA attempting to exert authority over e-cigarettes. Considering the amount of male enhancement and weight loss drugs plaguing late night television that have gone unregulated by the FDA for years, the question of why they are paying so much attention to e-cigarettes is being raised.
Arguments that because the cartridges are available in varying flavors they may be appealing to children has been presented as well, even though there are a myriad of over-the-counter items strictly for adults available in flavors, including cherry-flavored cough syrups (often with a large percentage of alcohol) and berry, orange, and mint-flavored antacid tablets. Flavored energy drinks are available across the country for minors to purchase while the more compact and potent energy shots are often marketed at the checkout counters of gas stations and department stores within easy reach. Toy-shaped novelty cigarette lighters for adults also grace gas station counters and somehow do not do not create this level of government outcry.
“I think they’re overextending themselves and focusing their efforts in the wrong area here,” says Ellis. “People are being given the choice of ‘cheap, but deadly’ and ‘expensive, but safe’ and a lot of people don’t have the money for the safe option. They either have to pay an outrageous tax to government to get the nicotine or they have to jump through hoops to be able to get an FDA-approved nicotine inhaler that costs just as much as the e cigarettes. To avoid the hassle of going to the doctor and getting a prescription, most will choose tobacco. We’ve tried to create a middle ground here.”
With the economy in its current state, people search for cheaper options when it comes to everyday life and for most, nicotine replacement therapies like gums, patches, and inhalers are quite simply out of reach. Even for the ones who can afford the prescriptions or the over-the-counter patches and gums, the habit of picking up a cigarette and taking a drag off of it still lingers in the back of their minds.
In a nation that is struggling with the demands of a failing healthcare system, a failing economy, and a disgruntled people that have had enough of both, the question remains whether a product caught in the middle will continue to be a source of contention between the government and the people.

Has the self proclaimed “legal Terrorist” slipped again with questionable tactics and actions concerning e cigarettes?
John Banzhaf, a self proclaimed public interest lawyer has once again been caught by his own actions and words by an electronic cigarette blogger that has exposed some blatent and potentially corrupt actions by the head of ASH (Action on Smoking and Health).
A newly released blog post has revealed some evidence of foul play by John Banzhaf, that prides himself on being refered to as a “legal terrorist” and has been a thorn in the sides of many companies across the U.S., costing the companies millions in legal fee’s.
The blogger, known only as “admin” has made several post on John Banzhaf and ASH, claiming that the professor of law is nothing more than a “leach” on society and a “danger” to freedom in the United States.
The blogger shows some compelling evidence of falsehoods and potential public deceptions by this famous, but scrutinized attorney. There is also allegations of a conflict of interest in the ongoing electronic cigarette battle that is currently underway in a federal court because of financial ties between Pfizer and John Banzhaf’s ASH .
Many bloggers have attacked this attorney in the past because of his attacks on McDonalds and other food service companies over patrons becoming over weight and it looks like the bloggers are on him again over the electronic cigarette because of claimed ” double standards and hypocrisy”.

The “Terminator” has just terminated a bill that would have outlawed the electronic cigarette
With a bold and decisive stroke of his pen, Governor Arnold Schwarzenegger may have put to rest a bill that would have banned the electronic cigarette from the state of California. This action by the Governor has put this bill back in the hands of lawmakers to either try to get to a 2/3 majority to override the veto or re-write the bill so that it just regulates the age restrictions, which would have likely passed and been signed without any problems.
“We do not mind regulation” states Tiffany Ellis of E Cigarettes National, “We just do not want them banned, and like the Governor stated, it should be left to the discretion of the adult choosing to use them, not policy makers.” Like Ellis, most suppliers and retailers claim that they do not mind regulation and age restrictions, but strongly oppose any bans to the electronic cigarettes that they use and market to the public.
The message sent to the lawmakers by the Governor was clear and explained his motives in full concerning the rights of the people and current litigation on the matter in a federal court or law. Below is a copy of the message sent back to state lawmakers. you can read the official message here.

I am returning Senate Bill 400 without my signature.
While I support restricting access of electronic cigarettes to children under the age of 18, I cannot sign a measure that also declares them a federally regulated drug when the matter is currently being decided through pending litigation.
Items defined as “tobacco products” are legal for anyone over the age of 18. If adults want to purchase and consume these products with an understanding of the associated health risks, they should be able to do so unless and until federal law changes the legal status of these tobacco products.
For this reason, I am unable to sign this bill.

Only time will tell if the lawmakers of California will get the message from the people and the governor and halt any attempts at banning e cigarettes prior to a federal ruling, or pushing for a 2/3 vote to override the governor and the people of California.

It is a growing trend online and at local malls to see the new electronic cigarette for sale and people, both smokers and non smokers flocking to them as more and more information is released on the effect they are having on the population.
Most of the smokers that have tried them swear by them with claims of leaving tobacco cigarettes behind and claims of better health and appearance to boot. There was even a study from South Africa that claims that 45% of the people who switched to the e cigarette have now quit using tobacco and are feeling better. All of the scientist and doctors in that study were amazed at the results and highly approve of them as a cessation product and a plain out healthier choice.
This is not the consensus here in the United States when it comes to the government and special interest though. There is still an ongoing battle in a federal court over the popular product with fierce support from most users, family members and even doctors and scientist that are shouting praises for the e cigarette and screaming corruption at the government and special interest for their position on the product.
Several of the board members on the FDA advisory board that are suggesting a ban have direct financial ties to large pharmaceutical companies which creates an open conflict of interest. These companies make profits from smoking cessation products that average a 2% quit rate, so it is in their interest to keep a product off of the market that helps 45% quit smoking according to unbiased studies with no financial ties to special interest.
What is really had to swallow is that these same special interest groups that are funded by these companies also wrote the recent anti-smoking legislation that actually keeps tobacco legal and kills over 400,000 Americans each year. This is a travesty that the ones who claim they want to help people quit tobacco are the same ones that are protecting it and profiting on the funding companies ability to market products that do not work, while trying to ban the products that do work.
Even with all of the corruption from the special interest, the FDA recently put out lab results that were not factual and were misleading to scare the people away from the electronic cigarette. They did not use a control that was equal to the product they were testing and completely ignored the dangers of tobacco that most use the electronic cigarette to avoid. The current problem is that the coming legal decision may not be based on fact or truth, but rather, based on laws that were written in the past to protect the special interest of a few companies.

NJ Senate Approves ‘E-Cigarette’ Restrictions
TRENTON – The state Senate voted 38-0 Thurday to approve a bill to apply the provisions of the “New Jersey Smoke Free Air Act” to restrict the use of electronic smoking devices, commonly known as “e-cigarettes.”
The bill (S-3053) would expand the definition of “smoking” to include e-cigarettes and extend the ban on smoking by minors to include the use of e-cigarettes. It would define smoking as the burning or inhaling of tobacco or any other matter than can be smoked or inhaled, or the inhaling of smoke or vapor from an electronic smoking device.

“When a user puffs on an e-cigarette, which is a stainless steel tube designed to look like a real cigarette, they inhale a vaporized solution that usually contains nicotine,” Sen. Bob Gordon (D-Bergen) said. “The liquid often contains flavoring, such as chocolate or cherry. It seems obvious the people who make these devices are trying to make them attractive to younger people.
The e-cigarettes have a glowing red tip so that they look like a real cigarette. The heated solution produces a mist that is inhaled and exhaled, and a light-emitting diode at the end of the tube simulates the glow of burning tobacco. The device is powered by a rechargeable lithium-ion battery.
“The battery warms the liquid nicotine and propylene glycol from a replaceable plastic cartridge when a person inhales the device,” Sen. Joseph Vitale (D-Middlesex) said. “Propylene glycol, which is used in antifreeze, is the liquid that vaporizes when a person exhales and produces a mist that is nearly identical in appearance to tobacco smoke. According to a 2009 statement by Health Canada, the Canadian federal government agency with regulatory jurisdiction over health issues, inhaling propylene glycol is a known irritant.”
The “New Jersey Smoke Free Air Act” already prohibits the smoking of a cigar, cigarette, pipe or any other matter or substance which contains tobacco or any other matter that can be smoked in indoor public places and workplaces.
“Our bill would update the current law to define an electronic smoking device to mean an electronic device that can be used to deliver nicotine or other substances to the person inhaling from the device, including an electronic cigarette, cigar, cigarillo, or pipe,” Gordon said.
The federal Food and Drug Administration (FDA) has refused entry to shipments of e-cigarettes coming into this country on the grounds that these are unapproved drug device products; however, these devices have made their way into this country and are sold online and in some shopping mall kiosks.
Under the bill, the penalties that currently apply to a person who smokes tobacco in an indoor public place or workplace would apply to a person who uses an e-cigarette: a fine of not less than $250 for the first offense, $500 for the second offense and $1,000 for each subsequent offense.
U.S. Senator Frank Lautenberg (D-N.J.) has called for the federal Food and Drug Administration to remove e-cigarettes from the market. The ban on e-cigarettes is also supported by The American Cancer Society Cancer Action Network, the American Heart Association, the American Lung Association and the Campaign for Tobacco-Free Kids.
Advocates of electronic smoking devices say that they can be a tool to help smokers quit using traditional cigarettes and point to a 2008 study in the Health New Zealand medical journal that concluded that they are a safe alternative to smoking.

Special Interest Deceptions Continue to Rampant About Electronic Cigarettes
As the battle continues over the electronic cigarette, more deceptive practices are being used to send out dangerously misleading information on the popular product.
GAINESVILLE, Fla., Dec. 17 /PRNewswire/ — Over the last few weeks there has been an increase of the amount of scare language that is used by e cigarette opposition in an attempt to scare the population concerning the Electronic Cigarette. When can a cigarette be legally smoked in a place of business, restaurant, bar or even on a commercial airplane?
Anytime would be the answer if the “cigarette” is one of the electronic products now on the market. The “healthier alternative” by Smart Smoker is similar to a patch or chewing gum, as it provides an alternative nicotine delivery system, that is available in pharmacies to help a person in his quest to stop smoking. Smart Smoker recently arrived on the Franklin County scene in two locations, including Family Pharmacy and Raven’s Country Store. While the product contains degrees of nicotine, ranging from high to none, there is no odor or tobacco-related danger from the liquid-based vapor smoke that is emitted when the cigarette is “puffed” or inhaled. The electronic cigarette kit comes in a menthol or regular tobacco-like taste. It emits a red glow on the end when it is being “puffed.” The end is also gray and resembles ashes, and the filter is brown in color. The only visible difference is that the plastic cigarette has a shiny appearance. Not only is Smart Smoker an alternative to regular cigarettes, it is also cheaper to use, according to Howard Schapiro, who smoked two to three packs of cigarettes a day before he saw the product on the “Doctor” television program early this year. “I’ve had two heart attacks, but I just couldn’t not stop smoking. My doctor told me he couldn’t help me anymore me unless I stopped smoking,” he said. “So I went online and checked it out. When I got to the comments section and asked about it being available in the United States, it (the product) hadn’t reached here yet,” he said. “So I got in touch with the company in England, and the next thing I knew, I was on an airplane going over to the U.K.,” Schapiro added. “Now, I supply the product to Layman’s Candy and Tobacco Co. in Roanoke. They liked what they saw and took a chance on it.” “I have stopped smoking cigarettes and now use Smart Smoker,” he said. “But I an still able to use that hand-to-mouth habit developed in smoking.” The back of the box notes that the product is 100 percent legal to smoke any place, there is no pollution, no tar, 80 percent cheaper than cigarettes with no passive smoke. “While it’s perfectly legal to use, the final word is up to the business, restaurant or store owner. If he says you can’t use it, then you have to do what he says,” Schapiro explained. “The liquid smoke I inhale is not harmful, and I get the taste of tobacco. Of course, there was a difference in the taste of what I was smoking and what I got using this product,” he explained. “Like switching brands of cigarettes — it takes a little getting use to.” The deluxe model contains two batteries (body of cigarette), the atomizer, a wall-model recharger and five cartridges of nicotine — two high, two medium, one low and one none. The deluxe sells for between $55-$60. One cartridge of nicotine equals about a pack of cigarettes, “once a person gets use to smoking it,” Schapiro said. Using the various degrees of nicotine from high to low allows the user, if they desire, to wean themselves from their nicotine dependence. “The smoke is a liquid vapor containing nicotine mixed with either propylene glycol or common glycerin. Both are common food additives,” he said. Once the five cartridges of the starter kit are used, a five-pack of cartridges can be purchased for about $8, according to Jessica Beckett, manager of Raven’s. The number of cartridges equals about five packs of cigarettes, equal to paying $2 for a pack of tobacco cigarettes, she added. Schapiro also noted that if a person takes too many “puffs” of nicotine close together, the light at the end of the cigarette will turn green and shut off for five minutes as a safety measure. The batteries, like a cell phone, need to be charged after being purchased, Schapiro said. It should be recharged for a full eight hours the first time. Afterwards, the charging time varies from one to three hours. Two batteries are included, so one can be in use while the other is in the charger. Schapiro said the electronic cigarettes are mostly made in China, but The Smart Smoker Co. Ltd. has the product shipped to the U.K., where changes are made and the product is improved. It has a 60-day guarantee on the electronic parts, and the product is only a 1-percent defect rate once it passes the stringent standards in the U.K, Schapiro added. Although deemed safe, the company does not sell the produce to anyone under the age of 18. “We don’t want to attract young people to the product, we want to provide adults with an alternative to tobacco,” Schapiro said. “It’s very simple to operate,” he explained. “The atomizer screws into the body of the cigarette. Then the cartridge is inserted into the atomizer, and the filter top is placed over the body and covers the cartridge.” There are only two chemicals used in the Smart Smoker, while there are 4,000 plus in cigarettes, Schapiro continued. “Smart Smoker is just beginning to break onto the scene in this area. Every time someone sees me ’smoking’ it, they have nothing but questions. They seem to like what they hear,” he added. Noting that a carton of cigarettes has reached $40 to $50 a carton, “the Smart Smoker is much, much cheaper and has not been found to be harmful, that alone was enough for me,” Schapiro said. “But I am now off tobacco cigarettes.” “Smart Smoker is not only the answer for someone who wants to quit, but it is also the answer for owners of restaurants and bars in the state worried about the news laws pertaining to second-hand smoke. The safe, odorless, water vapor isn’t offensive to anyone, and I can smoke after a meal,” Schapiro said.

City smokers begin turning to e-cigarettes

COLUMBUS — Local electronic cigarette use may be spurred by recent freezing temperatures and the statewide smoking ban, but health advocates are cautioning people of marketing claims and use of the unregulated product.
Because the battery operated devices, also referred to as “e-cigarettes”, are not considered a tobacco product, there is no law governing its sale or use.
The Food and Drug Administration is currently awaiting a decision in a federal case brought against it by electronic cigarette companies to keep e-cigarettes out of FDA control.
The devices are used to vaporize e-liquid, consisting of nicotine, flavor and other chemicals such as the solvent propylene glycol, contained in e-cigarette cartridges for inhalation by the user.
Mitch Nuttelmann, owner of Nuttelmann Enterprises, began selling the product regionally in March in anticipation of the smoking ban going into effect, and while the market is beginning to emerge in Columbus, he said many Norfolk smokers began using e-cigarettes.
“There is no tar, no carcinogens, no second-hand smoke,” Nuttelmann said. “It produces a vapor mist and all you blow out is H2O. It’s clean smoking.”
Because the product does not contain tobacco and does not have to be lit, it is not prohibited under the smoking ban, Nuttelmann said. In addition to heralding it as a smoking alternative, he said the product could be used as a smoking cessation alternative because cartridges are designated with varying levels of nicotine.
Ruth Mueller, coordinator for Tobacco Free Platte and Colfax County coalitions, said the FDA has not tested nor approved the product and hopefully people will avoid it until proper examination can be conducted.
“What we know is very limited and that is where the danger lies,” Mueller said, especially concerning nicotine levels and rate of inhalation.
Nicotine levels in a single cigarette range from 1.5-3 milligrams, whereas a single e-cigarette cartridge can contain levels from 0-24 milligrams.
Because nicotine can be an addictive substance that increases blood pressure, heart rate, respiratory rate and causes the release of dopamine, that is where a bulk of the concern lies, Mueller said.
“Nicotine is not healthy, (and) that’s where some of the danger is,” she said, especially since “no one is sure how people are actually using it, if they inhale a whole cartridge in one sitting” or in multiple sittings.
According to the FDA, public health experts expressed concern that electronic cigarettes could increase nicotine addiction and tobacco use in young people.
While neither of the local tobacco stores sell e-cigarettes, the product has sold at some local bars and convenience stores in the area, such as East 30 Bar & Package.
Judy Meays, owner of East 30 Bar, said she has sold a few and e-cigarettes have drawn additional interest by some of her customers.
While she has not seen their use in her establishment, some who bought the product did so for home use.
“They bought them for when it’s cold so they don’t have to go outside the house,” Meays said.
Kim Schaffer, manager of Cigarettes & More in Norfolk, said sales of e-cigarettes have been significant.
“We sell them like crazy,” Schaffer said. “Not only can you smoke them anywhere, there is no smoke, nothing burning,” which can create a fire hazard.
“You can smoke in bars and restaurants or anywhere else,” she said, and “not have to go outside, especially right now.”
Schaffer not only sells e-cigarettes but she has become a user and advocate as well, attributing their use to improving her health by reducing her two pack a day habit down to one-half pack daily.
Her doctor did some research, and she said he didn’t see anything wrong with them. She said he wished more smokers would utilize them rather than regular cigarettes.
“It has helped tremendously. A lot of people I know had problems with breathing,” she said, but since changing to e-cigarettes they have experienced “improved lung capacity and better breathing.”
“It’s amazing,” Schaffer said.
Mueller said such claims have yet to be verified as the products have not been submitted to the FDA for evaluation or approval. The products to not contain any health warnings comparable to FDA-approved nicotine replacement products or conventional cigarettes.
Nobody “is sure of all the effects or how people are actually using it,” Mueller said, because “it has not been tested, it has not been approved … so buyer beware.”

“I think there’s absolutely no doubt that it is a safer alternative to regular cigarettes.”
He estimated that electronic cigarettes carried a risk that:
“…is probably in the order of 99 percent less harmful than smoking.”
While acknowledging that an FDA study did find traces of carcinogens, he pointed out that banning items based on the quantities found would also mean the FDA would “…have to ban half the foods that are available.”
The carcinogens, he explained, were also found in FDA approved smoking cessation aids, and indeed in all products that utilised nicotine from tobacco plants.
According to the professor, much criticism of the electronic cigarettes by public health was due to an all out war on tobacco. He compared it to the problem of drug use, saying that people who are utterly opposed to the use of drugs also oppose needle exchanges, despite the fact that needle exchanges could save many lives.
The Professor did have some reservations about quality, saying that there was a need for regulation of the production of electronic cigarettes.
Professor Carl Phillips, who runs the TobaccoHarmReduction.org site, is one of a number of experts in tobacco and Tobacco Harm Reduction who have come out in favour of the device. Other experts who have have spoken out in favour of the electronic cigarette in interviews include Dr Joel Nitzkin, Chair of the Tobacco Control Task Force for the American Association of Public Health Physicians, Professor Siegel, a specialist in preventative medicine and public health, and David Sweanor, a former advisor on tobacco control to the WHO.

The following are a few common misconceptions about the government’s actions and attitudes towards smoking Americans:
Myth #1: The revenue from tobacco taxes is being spent on anti-smoking or other health-related programs.
Fact: For several years the majority of the revenue from tobacco taxes went to anti-smoking initiatives and state Medicaid funds. But as the economy continues to flounder and federal and state budgets get squeezed, tobacco tax revenues are being funneled into programs and projects unrelated to tobacco usage, such as children’s health insurance, education, and infrastructure projects.
Moreover, in 1998, 46 states settled lawsuits against the four major tobacco companies to recover tobacco-related health care costs, joining four states — Mississippi, Texas, Florida and Minnesota — that had reached earlier settlements.
Under these settlements the tobacco companies are required to make annual payments to the states totaling approximately $246 billion over the first 25 years. Much of this money, including future receipts, has already been spent in an attempt to cover current state budget deficits.
Myth #2: Smokers cost the government more in health care expenses.
Fact: As a justification for increasing the tobacco tax, the government has been harping on the notion that smokers draw on the health care system more than non-smokers, and that the states must carry this “extra” financial burden. But according to a recent CDC study, the final months of a smoker’s life are not more expensive considering that smokers die some 10 years earlier than nonsmokers, and those premature deaths provide a savings to Medicare, Social Security, private pensions and the like.
Myth #3: The tobacco taxation is turning away smokers.
Fact: According to another recent study by the CDC, the percentage of U.S. smokers has remained virtually unchanged from 2004 through 2008. What the tobacco tax has done is increased the number of bootleg cigarette sales, as people try to take advantage of tax differences between the states.
Myth #4: The tobacco taxation is slowing down the production of tobacco products.
Fact: The big tobacco companies have a history of quickly adapting to and taking advantage of the changing laws and taxation rules. For a recent example, consider how the companies responded to the tax increase on roll-your-own tobacco.
Myth #5: The government is focused on effective anti-smoking techniques and initiatives.
Fact: According to the CDC, from 2000 to 2009, states have received approximately $203.5 billion in tobacco-related revenue. CDC researchers claim that if states were to use just 15 percent of the money they receive from tobacco, they could adequately finance tobacco-control measures at CDC-recommended levels. Non-tobacco ‘E-Cigarettes’ Will Also Fall Prey To Smoking Ban

More than a year after MaltaToday revealed that the Health Ministry had classified the tobacco-free ‘e-cigarette’ as a tobacco product, a legal notice has established that even these devices will fall under the smoking ban.
The legal notice states that any “device which is intended as a substitute to a conventional tobacco product” shall fall under the Tobacco (Smoking Control) Act.
The e-cigarette is a tobacco-free device that is used to replicate the sensation of a traditional cigarette by means of an electronic simulation. Containing neither tobacco, nor tar, it is a nuisance-free solution for passive smokers.
According to the legal notice, any device bearing the word ‘cigarette’ or ‘tobacco’ which is intended as a substitute to a conventional tobacco product shall be deemed as a tobacco device.
It further stipulates that “all tobacco devices are to comply with the provisions of the Tobacco Act”, which means that they cannot be freely advertised, that they cannot be smoked in enclosed public spaces and that they can only be used by adults over the age of 18.
The e-cigarette looks very much like a plastic cigarette, with a mouthpiece containing a replaceable cartridge filled with liquid containing nicotine, a solvent called propylene glycol and flavourings. As smokers inhale, a sensor between the mouthpiece and the rod (which is actually the device’s rechargeable battery) activates a microprocessor to disperse the cartridge liquid into tiny droplets onto a small, inbuilt burner.
As the droplets sense the heat, the liquid is vapourised along with the nicotine. When the user inhales this vapour, the feeling of traditional smoking is simulated, and the vapour exhaled is somewhat similar to normal cigarette smoke – with the exception that it is odourless and it settles after a few seconds.
Those making use of it get their nicotine fix without the adverse effects of a normal cigarette. In the UK, the e-cigarette has allowed smokers to puff away happily in public spaces, legally and with no complaints from bystanders.

E-Cigarette Law Suits Being Made Easy
Any person who had purchased an e-cigarette will be able to bring his or her own class action law suit against the seller, or join an
existing class action and possibly share in any damages awarded to users of this new product which the Food and Drug Administration [FDA] has declared “illegal,” says public interest law professor John Banzhaf, who has been leading the battle for FDA regulation of the product.
Banzhaf prompted the FDA to warn the public about the dangers of e-cigarettes, including hidden carcinogens and other toxic chemicals, encouraged the several legal actions against them which have already been brought or are about to be filed, and used legal warning notices to persuade PayPal and Amazon.com to give up e-cigarette sales. He’s also the man behind the ban
on cigarette commercials and public smoking bans, and he’s been called the “Dean of Public Interest Lawyers.”
In response to requests for legal assistance he is receiving from persons who purchased e-cigarettes based upon claims of safety, who subsequently learned that an FDA study showed that they contained deadly toxins and cancer-causing chemicals, Prof. Banzhaf has posted on line a template for drafting a class action law suit complaint against sellers of e-cigarettes. With this simple template, any attorney contacted by an e-cigarette purchaser can easily file his or her own new law suit.
This could be important because the plaintiffs and the attorneys who are the first to file class action product liability law suits often end up with the lion’s share of money recovered — including attorney’s fees — so a race to the courthouse to be the first to file in each state is quite possible, says Prof. Banzhaf.
To file a law suit, a purchaser need not have suffered any medical or other problem as a result of using the product. Prof. Banzhaf explains that the legal actions which have so far been filed against e-cigarette sellers have relied upon consumer protection statutes which do not require any specific injuries.
Moreover, such law suits would not be affected by any decision in a federal law suit now pending which seeks to challenge the FDA’s jurisdiction over e-cigarettes. The FDA’s jurisdiction, and violations of consumer protection laws, are two very different legal issues, says Banzhaf.

For those e-cigarette purchasers who do not wish to retain their own attorney, Prof. Banzhaf says they may contact the attorneys who brought the initial class action law suit and seek to join the class or serve as plaintiffs in similar law suits in other states.
The legal actions filed to date have contended that sellers of c-cigarettes have violated consumer protection statutes by engaging in unlawful, unfair or fraudulent practices and unfair, deceptive, untrue or misleading advertising. Although the argument that the ads were unfair is based in part on scientific findings of the FDA, even a judicial ruling that the FDA at the time had no authority to regulate the product doesn’t invalidate the agency’s scientific findings about it, argues Banzhaf.
The FDA has reported that the e-cigarettes it tested contained detectable levels of known carcinogens and toxic chemicals to which users could potentially be exposed. The FDA said the toxic chemicals included diethylene glycol, “an ingredient used in antifreeze, [which] is toxic to humans”; “certain tobacco-specific nitrosamines which are human carcinogens”; and that “tobacco-specific impurities suspected of being harmful to humans – anabasine, myosmine, and B-nicotyrine – were detected in a majority of the samples tested.”
Banzhaf notes that virtually anyone who bought one or more e-cigarettes, based upon claims that they did not contain any of the cancer-causing chemicals found in tobacco cigarettes, would be able to bring a class action law suit in his or her state against the seller. Virtually all states have consumer protection statutes which permit law suits to be brought even if the purchaser suffered no harm from using the product.
The possibility of such law suits may be one reason why more e-cigarette wholesalers are finding it necessary to provide product liability insurance to their retail customers, and at least one insurance company is offering its own liability policies.
That company explains the need for such insurance this way: “the FDA has issued a warning about the product (e-cigarettes) because marketers are presenting the e-cigarette as a healthier alternative to regular cigarettes. In addition, the cartridge contains several chemicals including nicotine that are hazardous to your health.”

The Price Of Cigarettes In 2009: Where Is The Money Going?
Many smokers are still trying to catch their breath from the wave of federal and state cigarette tax increases that made headlines in 2009 — and with good reason. In some parts of the country, such as New York City, where local taxation is strong, the price for a pack of cigarettes is hovering around $10. But just how much of this price can be attributed to the wholesale cost of cigarettes?
A look at the actual numbers paints a pretty clear picture. Whether they like it or not, the truth is that every time a smoker forks over their money to light up, they’re actually making a rather generous contribution to federal, state, and local governments.
Here’s a brief rundown of all the factors that contribute to the total price of a pack of cigarettes:

The Factory Price: This is what the cigarette company charges wholesalers and distributors per cigarette pack. According to the Economic Research Service of the U.S. Department of Agriculture, as of June 2008, the average price charged by the major cigarette manufacturers for the top brands was $2.28. However, this does not include a series of cigarette manufacturer price increases that preceded the federal cigarette tax hike in 2009, as well as any promotional reductions by the manufacturer. Taking all of this into account, the average factory price is probably closer to $2.35 a pack.

The Federal Cigarette Tax: The federal tax rate is tacked on to the price per pack before it reaches the retailer. Currently, the federal tax is holding at $1.01 per pack.

Currently, there is no solid data on distributor and retailer mark-ups by state.
